The majority of us, I believe, were shocked to discover how much control governors and bureaucrats actually had over our lives as the pandemic spread two years ago.

The Constitution does grant the executive branch and states extensive ability to confront threats to public safety, according to Walter Olson, a legal scholar at the Cato Institute, but such powers are supposed to have a time limit. At the time, he declared, “Once the emergency is over, the government must store these dangerous weapons.”

Growing government threatens liberty

That stuck in my mind because everyone who follows the government knows that once it develops a thirst for more power, it often doesn’t give it up. I spoke with Kimberley Strassel, an opinion columnist for the Wall Street Journal, last week while she was in Grand Rapids for an event hosted by the Mackinac Centre for Public Policy. She is a keen observer of the government and believes that the unchecked growth of bureaucracy poses a serious threat to our freedom. According to Strassel, “We have been witnessing this increasingly significant risk from the growth of the administrative state for some time now.” It’s remarkable to see how much attention COVID has brought to this issue.

Strassel specifically points out Michigan as one of the worst states for excessive government intervention during COVID. Until her emergency powers were found to be unconstitutional for much of 2020, Governor Gretchen Whitmer ruled the state unilaterally. After that, she turned to the state health department to issue essentially identical directives. Let’s not forget that just a year ago, workplace inspectors in Michigan were drafting permanent regulations that would have required ongoing mask-wearing and other safety measures. Thankfully, those regulations were abandoned.

At the federal level, the extent of overreach is even more apparent. This overreach did not start with the current administration, but rather before it. In 2019, the former president Donald Trump went beyond his authority by declaring a national emergency at the border in order to bypass Congress and build his wall.

This set a dangerous precedent for the use of emergency powers. Currently, President Joe Biden is maintaining the national “public health emergency” as a justification for intrusive government regulations, such as the eviction ban, vaccine requirements for private companies, and mask mandates for public transit.

However, all of these laws have recently been overturned by the courts, which is a positive development. The growth of the administrative state can be attributed to the courts’ failure to uphold the separation of powers. Our current predicament is a result of this, as well as Congress’ refusal to take action other than passing large spending packages.
